New rules for organizations with foreign capital to enter the register of subjects small and medium enterprises

Dear Clients and Partners, 

We inform you that according to alterations to Federal Law No. 209-FZ, organizations with any percentage of foreign capital have a right to be included to the register of small and medium-sized businesses (MSP) in case the foreign party do not have the permanent location in offshore zones. Earlier the limit of foreign capital for MSP subjects was 49%. 

MSP subject should meet the following rules for the previous year: 
- average number of employees – no more than 250 people; 
- maximum income – no more than 2 billion rubles. 

Auditors from official register of audit firms audit the financial reports of foreign party and checks the correspondence of MSP criteria. Then the auditors form the list of organizations which meet the criteria of MSP and forward this list to Russian Tax Authority from July 1 till July 5 of current year. 

Starting from August 10 organization will be included to MSP register.
